General Terms and Conditions of Sale
Article 1: Scope of application
The general terms and conditions of sale apply exclusively to any current or future commercial relations between Dammann Frères, 1, rue de Réveillon, 28100 Dreux, France (" we") and the creator of the order ("you").
We can alter these general terms and conditions of sale at any moment, provided that we indicate these changes on our site.
Article 2: Orders
We undertake to accept your order according to the terms of these conditions of sale.
When you place your order, we inform you of the availability of products you wish to buy. However, if despite our vigilance, products prove temporarily unavailable (stockout, awaiting new supplies, etc.) after you have placed your order, we will inform you by e-mail and give you the choice of altering or cancelling your order. If any products turn out to be permanently unavailable (depleted stock, etc.) after you have placed your order, we will automatically cancel it and inform you by email before reimbursing any sums you have paid for the unavailable products.
By confirming your order, you accept all these general terms and conditions of sale, which you can view on the site, and acknowledge that you are aware of them, thereby renouncing recourse to any contradictory document including your own general purchasing conditions, as the act of purchasing entails acceptance of these general terms and conditions of sale. This confirmation and all the information we have registered constitute proof of our transactions.
Article 3: Prices
Prices are indicated in euros and are deemed to include all taxes due in line with French taxation, excluding carriage costs. We reserve the right to change our prices at any time. We undertake to apply the current prices indicated when you place an order.
With orders outside the European Union, prices will be zero rated for VAT when you enter your delivery address in the relevant form. Customs duty and any other taxes relating to the delivery of an item are to be paid by you and are your responsibility. We are not required to check or inform you of any applicable customs duties or taxes. To find out what they are, we advise asking the relevant authorities of your country. Under no circumstances are we obliged to pay for additional costs arising from the delivery of your order apart from carriage costs, which are described and invoiced when you complete your order on our site.
Article 4: Payment
Prices are payable immediately on the same date as the order. Cards issued by banks domiciled outside France must be international bank cards. Online payment with bank cards is entirely secure, and uses the SSL (Secure Socket Layer) protocol. The information transmitted is encoded by a software program amend cannot be read when it passes through the network.
We use the Sogecommerce by Société Générale and Paypal online payment solutions. Your order can only be processed when your payment has been accepted and this acceptance transmitted to our departments.
Article 5: Delivery
Unless other arrangements are made, delivery is made to the address indicated when an order is placed.
Delivery deadlines are for information only. We invite you to read the additional information about delivery.
Items are delivered by Colissimo (tracking against signature, without signature and collection point) and Chronopost (tracking against signature and relay point).
If a customer is absent when the item is delivered, the parcel is kept for 10 days at the buyer's local post office.
For home deliveries in metropolitan France Colissimo, delivery costs are free for any order over € 40 including tax. And for all orders of an amount less than € 40 including tax, delivery costs are € 4.50 including tax without signature, € 5.50 including tax against signature and € 4 including tax at the pick-up point. Home delivery times are estimated at 2 working days for mainland France.
For deliveries in metropolitan France Chronopost, the delivery costs amount to € 7.90 including tax against signature at home and € 5.40 including tax at a relay point. Delivery times are estimated at 1 working day after the shipment of the package from our premises to mainland France. Parcel delivered the next day (working day) in mainland France for orders placed before 12 a.m. from Monday to Friday. For deliveries outside mainland France, the amount of delivery costs is calculated at the end of your order, depending on the amount of your order. Delivery times vary depending on the destination country.
For deliveries in metropolitan France UPS to a UPS Access Point relay, the delivery costs are €3.20.

With deliveries outside mainland France, shipping costs are calculated at the end of your order, depending on the amount of this order. Delivery deadlines vary according to the destination country. Orders placed on Saturday or Sunday are processed the following Monday.
Orders placed on public holidays are processed the next working day.
Article 6: Cancelation, returns, refunds and claims
We guarantee the quality and condition of all the items we ship.
1/ If you wish to cancel an order in whole or in part before it is shipped, please do so by sending an email to service client.
2/In accordance with articles L.121-20 and thereafter of the Consumer Code, you have 14 working days from the delivery date of your order to return any items that do not suit you and request a refund.
In all circumstances, the cost of returning items is your responsibility.
The return request is a prerequisite for the acceptance and repayment of / product (s) returned (s) within 14 business days of receipt. Only the customer who placed the order has the power to exercise the right of withdrawal.
Just follow the steps below:
- print out the declaration of cancellation form
- complete and return this form by email to: email@example.com
- when we receive it, we will contact you to organise the item's return.
- Once the parcel is received, we will check the compliance of the item(s) returned, which must not be damaged or opened, in order to confirm our final agreement for a refund. A refund will be made via the means of payment used for the purchase.
When the returned products have been received with their delivery slip, Dammann Frères will refund you within 14 days. Only the customer who placed the order can exercise the right of withdrawal.
3/Any items damaged during transport can be replaced on presentation of photos of the Colissimo label with the tracking number, the damaged item and the parcel with its contents.
4/With any order returned to our premises by our carrier for the following reasons: unclaimed or refused, without having requested withdrawal, we will make a refund, deducting shipping costs except when shipment was free.
5/With claims concerning the quality of an item, please send us an email using the customer service contact form, with the following information: your contact details, the reason for the complaint, a photo, the "Best By" date, the batch number, and the date and place of purchase.
Article 7: Reservation of ownership
Unless other arrangements are made, delivery is made to the address indicated when an order is placed. Delivery deadlines are for information only, unless we have exceptionally agreed to deliver on a specific date. We invite you to read the additional information about delivery.
Article 8: Latent defect warranty and liability
If any product we have delivered to you proves to have a latent defect, we can decide to eliminate this defect or replace the defective product with another one. If we do not wish to eliminate the defect or replace the defective product, or are unable to do so, or if we are unable to do so within the required time because of circumstances beyond our control, you may, if you wish, send it back to us for a refund of the price and carriage costs, or request a discount on the sale price. The products on offer comply* with current French legislation
We undertake to take every care normally applied in the profession when carrying out the service we offer our customers. However, should we fail in our contractual obligations, our liability cannot be incurred if this is due to unforeseeable circumstances or a case of force majeure including but not limited to disasters, strikes, fires, floods, the malfunction or breakdown of equipment, means of transport or means of communication, or due to your actions.
Furthermore, our liability cannot be incurred for any delays due to stockout or if there has been an error in the presentation of products on our site, as photographs, texts and illustrations of the products are not contractually binding.
Article 9: Data protection
We undertake to protect your personal data. In agreeing to these general terms and conditions of sale, you acknowledge awareness of our commitment to confidentiality, and authorise us to collect and use this information. Our site has been declared to the CNIL (the French data protection authority) under number 1909967.
Article 10: Applicable law and jurisdiction
These general terms and conditions of sale are subject to French law and the Vienna Convention on contracts for the international sale of goods, excluding the United Nations right of sale. Any disputes arising from the commercial relations between you and us fall exclusively within the jurisdiction of the French courts.
Article 11: Cookies Policy
Cookies are small text files placed on your computer, tablet or smartphone when you visit a website.
The information they collect is used to simplify browsing, personalise services and content, offer functions to users, optimise the site’s performance and enable sharing on the social media. The maximum lifespan of a cookie is 12 months.
